Welcome to Slapshot Sweets. These Terms of Service ("Terms") govern your use of our website and the purchase of products from Slapshot Sweets. By accessing our website or placing an order, you agree to be bound by these Terms, our Privacy Policy, Shipping Policy, and Refund Policy.

If you do not agree with these Terms, please do not use this website.

1. ELIGIBILITY

By placing an order, you represent that you are at least 18 years of age or are using this website under the supervision of a parent or legal guardian.

2. PRODUCT INFORMATION

We strive to ensure that all product descriptions, pricing, images, and availability are accurate. However, errors may occasionally occur.

Because many of our products are hand-packed and sourced from multiple manufacturers:

• Candy colors, shapes, and flavors may vary.
• Packaging and branding may change without notice.
• Product images are for illustrative purposes only.
• Product availability is not guaranteed.

Slapshot Sweets reserves the right to correct errors, update product information, modify pricing, limit quantities, or discontinue products at any time without prior notice.

3. FOOD ALLERGY NOTICE

IMPORTANT ALLERGY INFORMATION

Our products may contain or be processed in facilities that also process:

• Milk
• Eggs
• Wheat
• Soy
• Peanuts
• Tree Nuts
• Fish
• Shellfish

Although we exercise reasonable care when packaging products, we cannot guarantee that any product is free from allergens or cross-contact.

Customers with food allergies purchase and consume our products at their own risk.

Slapshot Sweets is not liable for allergic reactions or any health-related issues resulting from the consumption of our products.

4. MELTED CANDY POLICY

Many candy products are sensitive to heat and weather conditions.

By placing an order, you acknowledge and agree that:

• Candy may soften or melt during transit.
• Melted candy does not necessarily indicate that the product is damaged or unsafe.
• Melted or softened candy is NOT considered damaged merchandise.
• Melted candy is NOT eligible for refunds, replacements, exchanges, chargebacks, or shipping claims.

Ice packs are available for purchase during checkout to help reduce the risk of melting but do not guarantee products will remain unmelted during transit.

5. PRODUCT SUBSTITUTIONS

Occasionally, selected candy varieties may become unavailable after an order is placed.

If this occurs, Slapshot Sweets reserves the right to:

• Substitute unavailable items with comparable products of equal or greater value; or
• Increase the quantity of the customer's remaining selections to meet the purchased weight.

Substitutions are made at the sole discretion of Slapshot Sweets.

6. ORDER PROCESSING

Orders are fulfilled in the order they are received.

Standard processing time is 3–5 business days unless otherwise stated.

Processing times may be extended during holidays, promotions, high-volume sales, or unforeseen circumstances.

Estimated delivery dates provided by shipping carriers are estimates only and are not guaranteed.

7. SHIPPING

Once an order has been accepted by the shipping carrier:

• Responsibility for delivery transfers to the carrier.
• Slapshot Sweets is not responsible for shipping delays caused by weather, carrier delays, mechanical failures, natural disasters, or other events beyond our control.
• Customers are responsible for providing a complete and accurate shipping address.
• Additional shipping charges may apply if a package is returned due to an incorrect or incomplete address.

8. RETURNS & REFUNDS

Due to the perishable nature of food products, ALL SALES ARE FINAL.

We do not accept returns on edible products.

Refunds or replacements may be considered only if:

• The incorrect items were shipped; or
• The order arrives damaged for reasons unrelated to heat or melting.

Claims must be submitted within 48 hours of delivery and include clear photographs of both the shipping package and the products.

All refund and replacement decisions are made at the sole discretion of Slapshot Sweets.

9. ORDER CANCELLATIONS

Orders may be canceled only if fulfillment has not yet begun.

Once an order has entered processing or has been packed for shipment, cancellation requests cannot be guaranteed.

10. CHARGEBACKS

By placing an order, you agree not to initiate a chargeback based solely on:

• Melted candy
• Weather-related product changes
• Shipping carrier delays
• Product substitutions made in accordance with these Terms
• Failure to review our posted policies before making a purchase

Slapshot Sweets reserves the right to dispute fraudulent or unwarranted chargebacks using order records, shipment tracking information, checkout acknowledgments, and these Terms of Service.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Slapshot Sweets shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our website or products.

Our total liability for any claim shall not exceed the purchase price of the affected order.

12. INTELLECTUAL PROPERTY

All content on this website, including but not limited to logos, product names, graphics, photographs, text, branding, and designs, is the exclusive property of Slapshot Sweets and may not be copied, reproduced, distributed, modified, or used without prior written permission.

13. GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms of Service, the use of this website, or the purchase of products from Slapshot Sweets shall be brought exclusively in the appropriate state or federal courts located within the State of South Dakota.

14. CHANGES TO THESE TERMS

Slapshot Sweets reserves the right to modify these Terms of Service at any time without prior notice.

Changes become effective immediately upon publication on this website.

Your continued use of this website following the posting of changes constitutes your acceptance of the revised Terms.
